Terms of Service
Draft. This document is pending review by a Nigerian-qualified lawyer and is not final legal text.
1. Acceptance of Terms
By accessing or using the Okim Logistics website, mobile applications, or services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Okim Logistics provides a platform connecting customers with independent delivery riders for package delivery, and with third-party vendors for the ordering and delivery of food and other goods, within Ibadan, Nigeria.
3. Eligibility
You must be at least 18 years old to create an account and use the Service. By using the Service, you represent that you meet this requirement.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
5. Orders and Deliveries
- Package delivery requests and vendor orders are fulfilled by independent riders operating on the Okim platform, not by Okim Logistics employees.
- Estimated delivery times are approximate and not guaranteed, due to factors including traffic, weather, and rider availability.
- You are responsible for providing accurate pickup/drop-off addresses and ensuring someone is available to send or receive the delivery.
- Okim Logistics reserves the right to refuse, cancel, or reroute any delivery that violates these Terms or applicable law.
6. Prohibited Items
You may not use the Service to send or order any illegal item, hazardous material, firearm or weapon, or any item prohibited under Nigerian law. Okim Logistics reserves the right to refuse any delivery request believed to violate this provision.
7. Pricing and Payment
Delivery fees are calculated based on distance, package size, and other factors as displayed at the time of your request. Prices are subject to change. All payments are processed through our designated payment providers.
8. Riders and Vendors
Riders and vendors operate as independent parties on the Okim Logistics platform under separate agreements (see our Rider Partner Agreement and Vendor Partner Agreement). Okim Logistics is not the employer of riders or the owner of vendor businesses listed on the platform.
9. Limitation of Liability
To the maximum extent permitted by law, Okim Logistics is not liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability for any claim is limited to the amount you paid for the specific order giving rise to the claim.
10. Account Suspension and Termination
We may suspend or terminate your account for violation of these Terms, fraudulent activity, or misuse of the Service.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria.
